Collapse of Human Rights in South Korea

First, let me express my thanks to Lawyer Kim and his Save Korea Foundation. They are, every day, saving Korea. The title of this talk is “Collapse of Human Rights in South Korea,” but what we are really talking about is the collapse of South Korea, or more precisely, the end of the South Korean state.

Moon Jae-in, the president of the Republic of Korea, wants to end the existence of the state he was elected to protect, the state he took an oath to defend. We are here together, this evening, far from Korea, because one thing unites us. All of us have pledged to defend the Republic of Korea. And all of us know one thing, that the most insidious enemy of Korea is its president.

Moon is the enemy of freedom and democracy and human rights in Korea. So to defend Korea, to save Korea, Koreans must first rid themselves of Moon. Moon must go. Tonight, we will talk about getting rid of Moon. Let’s get started. We start with April 15, 2020. That is the date of the National Assembly elections. On that day, all 300 seats in the legislature are up for grabs.

The election is important for many reasons, but I will focus on two of them. First, there is the amendment of the constitution of the Republic of Korea. The president may propose amendments to the constitution. Article 130 requires that two-thirds of the members of the National Assembly must approve a constitutional amendment before it is sent to a popular referendum. In that referendum, only a simple majority of people must approve.

April 15, therefore, is do or die, now or never. If it were up to Moon, he would propose to merge South Korea into the North the Democratic People’s Republic of Korea, the Kim regime. Moon may—especially because he is counting the votes—he may be able to get that simple majority of voters in the referendum. This means the only thing that reliably stands between a free and independent Republic of Korea and a totalitarian dictatorship is the National Assembly.

This means conservatives absolutely have to win at least 101 seats on April 15. Today, the main conservative party, the Liberty Korea Party, currently holds 110 seats. Conservatives, in minor parties, add a few more votes in the National Assembly.

Moon’s horribly misnamed Democratic Party of Korea, Minjoo, would, if it could, amend the constitution to get rid of all we hold dear.

How do we know this? We do not have to speculate. Most fundamentally, Minjoo, in early 2018 led an attempt to remove the notion of “liberal” from the concept of “democratic” in the constitution. The South’s “conservatives” turned back the effort, but the Education Ministry in June of that year tried to change the country’s textbooks, proposing to describe the nation’s political system as just “democracy.”

The Ministry ultimately succeeded in removing references to “freedom” in middleschool texts. And why would they think of doing this? On the Korean peninsula, democracy does not have to be “liberal.” Kim Jong Un’s regime rejects that concept but nonetheless maintains it is “democratic

Its formal name, after all, is the Democratic People’s Republic of Korea. Moon’s political party shares the “Democratic” label but is leading the attack on both democracy and liberal governance. Many speculate that Moon, to facilitate unification, is trying to make his constitution and republic compatible with North Korea’s.

So Job No. 1 for conservatives is to take back the National Assembly on April 15 so they can safeguard the constitution. That’s the first National Assembly issue. Second, the ultimate safeguard for the preservation of the republic is the removal of Moon. And that is also a National Assembly issue.

Article 65 provides for impeachment and adjudication. So, let’s look at the case of Park Geun-hye. Was she guilty of bad judgment in the choice of a confidant? Yes. Was she guilty of being a little remote? Yeah. Was she guilty of not exuded warmth? Certainly. But was she guilty of violating the Constitution or other acts 5 in the performance of official duties, the standard in Article 65? No. And was she corrupt? No. President Park Geun-hye was railroaded in the National Assembly.

She was impeached and convicted in a slick and sophisticated and cynical operation. The statement that Lawyer Kim has prepared seeks justice for President Park, but Moon is absolutely determined to deny her any justice now just as she was denied justice in her impeachment proceedings.

How do we know this? As my friend Lawrence Peck has explained, Moon is an expert in bringing “extremely dubious criminal defamation charges against critics.”Perhaps the most significant prosecution of a critic is that of Byun Hee-jai of Mediawatch. In December, Byun and three Mediawatch colleagues were found guilty of libeling JTBC, a cable TV channel, when they questioned the accuracy of its story about a tablet computer that was instrumental in the impeachment of President Park.

An acquittal of these journalists would have been tantamount to an admission that the JTBC story was inaccurate. That, Tara O, an analyst, explained to me, would have raised “the question why Park was impeached in the first place.” Given the unusual circumstances of the case— prosecutions of libel are rare and pre-conviction detention rarer still— there was a political decision to convict the four journalists. They were political prisoners.

And there have been other journalists wrongly jailed. In fact, there has been a collapse in human rights in South Korea under Moon. Under Moon, human rights has had a few bad years, a few very bad years. Moon is clearly eroding democratic institutions in the South. Since becoming president, he has exercised control of big broadcasters to reduce the airing of dissenting views and to promote North Korea’s.

These days, it’s not safe to say anything critical of Moon on any state-funded media outlet, especially anything critical of Moon’s approach to North Korea. To reinforce its control over messaging, Moon’s government also clamped down on social media, trying to remove content causing “social distrust.” Minjoo has gone after YouTube.

YouTube remains one of the only open venues for Koreans who disagree with Moon. Moon has tried to enact censorship laws, but his administration does not need a law to pressure YouTube. His administration began an investigation of Google Korea for tax evasion after the company refused a request from Minjoo to take down 104 YouTube videos.

Moreover, Moon has been relentless. The National Police Agency has been investigating stories that his administration has deemed factually incorrect. And you don’t need to be factually incorrect. Moon is now investigating about 70 South Koreans, some journalists, for no reason other than the fact they questioned where the president was for five hours in early April, when the wildfire raced across the eastern portion of the country.

Don’t even think of mentioning Kwangju massacre if you do not accept Moon’s narrative, if you insult “the May 18 Democratization Movement” as Moon calls it, with “preposterous remarks,” if you suggest North Korea had any hand in the uprising. Moon’s government has also sought to silence other critics.

For instance, in an attempt to promote reconciliation with Pyongyang, the administration has been pressuring North Korean defectors who have found refuge in the South to keep quiet about the horrific Kim regime. From all of this, we know that Moon Jae-in supports Kim Jong Un. In short, conservative voices are being persecuted, prosecuted, pressured, censored, and harassed. There is now “a reign of terror.” The intimidation campaign was imperceptible at first. Now it is all pervasive.

We can even see the fear of the government. Many young demonstrators in the antiMoon “Taegukgi” rallies in Seoul, the flag rallies, feel compelled to wear masks or otherwise hide their faces from photographers. There is reason for South Koreans to be concerned because dangerous elements now, as a practical matter, have license to do what they want.

In the reign of terror, pro-North Korea forces feel free not only to speak but also to act, to deny freedom to others. North Korea’s radical proponents hold rallies demanding the arrest of “scum”— those who have escaped the North to live in the South. Radicals have even put up in Seoul wanted posters naming two defectors, asking residents to report their whereabouts.

Because the pair is believed to be targeted by Pyongyang for assassination, the posters put their lives in danger. The now-notorious Baekdu Group and affiliates such as “Flower Wave” act openly and with impunity. They are dangerous. They have intruded into classrooms to shout propaganda. They have invaded the offices of the Daily NK, a web-based news organization, to intimidate staff.

They have broken into the offices of a human rights organization to disrupt operations. Baekdu Group members have made public death threats and staged mock public arrests with victims bound with rope, suggesting lynchings. They have scuffled with police.

Some South Koreans believe that “free democracy” is “currently on the verge of a collapse,” as a September 4, 2018 statement charges. Alarm is now widespread. That’s not the way it was supposed to be. “I will strive to get rid of authoritarian practices in the presidency,” Moon declared in his inauguration speech in May 2017. That promise has obviously not been kept.

Although he made his name as a human rights lawyer and campaigner for democracy, he has been far more aggressive in the use of state power than his predecessor, So, as the Save Korea Foundation tells us, the U.N. should appoint a special rapporteur for South Korea. The South Korea of tomorrow, unfortunately, could resemble the South Korea of the past. Or maybe even resemble North Korea.

Moon, as we have talked about, wants to unify the two Koreas. Since the division of Korea in 1945, every Korean leader, both north and south of the Demilitarized Zone, has advocated unification. It’s no surprise then that in his summits with Kim Jong Un, Moon has pushed the union of the two rival Koreas. Both Seoul and Pyongyang have put forward unification schemes.

Most of these proposals contemplated, as an interim step to full union, one state with two separate governments, but even these loose arrangements failed to gain necessary support. The two Korean states have proven so different and hostile that a “marriage of equals” has never been implemented. Implementation could occur soon, however. Moon looks like the first Korean leader to accept unification on the terms of the other state, and unlike his predecessors, he is working hard to achieve union.

Working so hard that Moon is taking down South Korea’s defenses. His 17-page agreement of last September with Kim Jong Un favors the attacker, North Korea, more than the defender, the South. He has been unilaterally taking down the South’s defenses near the Demilitarized Zone.

He has been making plans to weaken the capability of the South Korean armed forces. He has been undermining the alliance with the United States. Only one nation has pledged to defend the Republic of Korea. It is the nation that rushed to the defense of the South when North Korea launched its invasion on June 25, 1950.

It is the one nation today with forces on Korean soil to defend Korea. It is the United States of America. And Moon, although he says he supports the alliance, acts as if he wants to end it. He has allowed his senior officials to mischaracterize the command structure of the alliance. He has made it difficult to maintain the only emplacement of the THAAD, the Terminal High Altitude Area Defense, system.

He has gone behind the backs of his American allies when he came to the infamous Three Nos agreement with Beijing at the end of October 2017, no to the hosting of additional THAAD batteries, no to participating in an integrated missile defense system with the United States, and no to joining a South Korea-Japan-U.S. alliance.

These three negative commitments undermine an effective defense of the Republic of Korea. They are a capitulation to “Chinese bullying” in support of the North Korean aggressor. I cannot say that Moon hates America.

But when President Trump visited South Korea at the end of last month, when Moon and his wife stood next to the American leader, the First Lady was seen wearing a blue butterfly pin on her dress. The blue butterfly is a symbol of anti-Americanism in South Korea, so Moon went out of his way to disrespect not just Trump, but the United States.

I cannot say that Moon Jae-in is a traitor to South Korea, but I can say this: If he were a traitor, he would be doing exactly what he is doing today to undermine freedom and democracy, and human rights in the Republic of Korea.

Let me close with one point. In the last few weeks, Moon’s administration has stirred up hatred of Japan. I can understand anti-Japanese feelings. My dad fled the Japanese during the Second World War. He along with millions of other Chinese moved west to avoid the marauding Japanese army as it swept across China.

But today, no Japanese alive made the decision to invade China. No Japanese today was in a position of authority in Korea. As far as I can tell, Moon Jae-in is whipping up anti-Japanese sentiment because that is the only thing he can do to regain popularity, to retain power.

Let me say this: if war ever comes to Korea again, if North Korea invades, if Chinese troops move across the DMZ, South Korea will desperately need Japan. The U.S., as a practical matter, cannot defend South Korea without the American bases in Japan, without the active support of the Japanese government.

Moon acts as if he does not care about South Korea, however. He is, by word and deed, pro-North Korea, pro-China, anti-America. He is, in short, a danger to South Korea. So Moon must go if we are to preserve the Republic of Korea. Therefore, let’s make a pledge together.

We will make sure freedom in Korea never dies! Let me hear you say it. Let me hear you shout it. Freedom will never die! Freedom will never die! Because of your dedication and determination, freedom in Korea will never die!
